The present paper addresses the problematic provisions on voluntary return, detention and the border procedure as part of the proposal of the European Commission for a recast of the Return Directive. It builds upon the “Recommendations for humane return policies in Europe“; published in May 2018 and urges the co-legislators to ensure that return of illegally staying third-country nationals is carried out in full respect of their dignity and their fundamental rights.
