JRS Europe Joint Statement – EU Commission proposed regulation on returns of third country nationals

On March 11, the European Commission proposed a draft regulation aimed at creating a “fair and firm” system for returning people to third countries. However, we believe this proposal will lead to significant human rights violations, increasing suffering for those seeking a better life. The proposed legislation risks imposing prolonged detention, complex procedures, and returns based on vague “arrangements” with third countries.
We strongly oppose this regulation, fearing it will create a de facto common detention policy, with Member States prioritizing security over human dignity. The regulation introduces punitive measures, extends detention periods up to two years, and prioritizes forced returns over voluntary departure, without considering adequately humane alternatives and less coercive measures.
Voluntary return should always be prioritized, allowing individuals the autonomy to decide their future. Additionally, the reintroduction of “return hubs” in third countries, under ambiguous agreements, raises serious concerns about accountability and respect for fundamental human rights.
JRS Europe urges EU legislators to amend this proposal by ensuring human-centered solutions, such as:
- Placing human dignity at the center of return procedures.
- Prioritizing less coercive measures than detention.
- Prohibiting the detention of families, minors, and vulnerable individuals.
- Extending the deadline for voluntary returns to three months.
- Abolishing return hubs outside EU territory.
Protecting borders must not come at the expense of people’s rights and dignity. JRS Europe will continue to advocate for fair, humane migration policies and offer support to forcibly displaced people.
